Terms of Service & End User License Agreement

These terms govern your use of the PommeToys macOS application, website, licensing service, and related support (together, the "Services"). PommeToys is independently developed and is not an Apple product. By downloading, installing, purchasing, or using PommeToys, you agree to these terms. If you do not agree, do not use the Services.
1. Eligibility
You must be legally able to enter into a contract in your place of residence. If you use PommeToys for an organisation, you confirm that you have authority to accept these terms for that organisation.
2. License
PommeToys is licensed, not sold. A purchase grants one user a personal, limited, non-exclusive, non-transferable license to install and use PommeToys on the number of Macs covered by the tier purchased — 1, 3, or 5 Macs — that the user owns or controls. The number that applies to your purchase is shown at checkout and on your receipt. You may move the license between Macs by deactivating one and activating another.
The license is perpetual, subject to these terms. Every update and future version released under the PommeToys product name is included without an additional license fee. This lifetime-upgrade promise does not require us to release a particular feature or follow a particular release schedule, and it does not include separately branded products or services unless we say otherwise.
3. Free trial
PommeToys offers a full-featured 7-day free trial. After the trial ends, continued use requires a purchased license.
4. Purchases, taxes, and refunds
Paddle is the merchant of record and authorised reseller. Your transaction with Paddle — including payment, invoicing, applicable taxes, and payment support — is also governed by Paddle's Buyer Terms. The price and any applicable taxes are shown at checkout.
Our 14-day money-back guarantee is described in the Refund Policy. Approved refunds are processed by Paddle and deactivate the associated license.
5. Updates and compatibility
All PommeToys updates and future versions are included with your purchase at no additional charge. If we release PommeToys 2, 3, or any later version, your existing license includes the upgrade.
Updates may require a supported version of macOS. We may change or remove a feature when reasonably necessary for security, reliability, legal compliance, or compatibility with changes made by Apple, but we will not intentionally disable a valid purchased license solely to force an upgrade.
6. System permissions
Some features require permissions that you grant in macOS System Settings, including Accessibility and Screen & System Audio Recording. PommeToys explains why a permission is needed before directing you to the relevant setting. You may revoke a permission at any time; the affected feature will then stop working or operate with reduced functionality.
7. Acceptable use
You may not:
- redistribute, resell, rent, sublicense, or publicly share PommeToys or a license key;
- use one license for more users or Macs than the license permits;
- publish or share license keys, or circumvent (or attempt to circumvent) the trial or licensing mechanism;
- reverse engineer, decompile, or disassemble the software, except to the extent applicable law expressly permits it despite this restriction;
- use the Services unlawfully or in a way that harms, overloads, or interferes with the Services or other users.
8. Ownership
PommeToys, including its software, website, design, text, and branding, remains the intellectual property of its developer and licensors. These terms grant only the license stated above and do not transfer ownership or other intellectual-property rights.
9. Availability and support
We may maintain, update, or temporarily interrupt online parts of the Services. A valid lifetime license is designed to continue working offline, but purchase, activation, deactivation, recovery, and update checks require an internet connection. Support is provided through support@pommetoys.app; no specific response time is guaranteed.
10. Warranties
To the maximum extent permitted by law, PommeToys is provided "as is" and "as available", without express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that every feature will work without interruption or error on every Mac, peripheral, app, or future version of macOS.
Nothing in these terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, the developer will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost data, profits, or business opportunity arising from the Services. The developer's total liability arising from PommeToys will not exceed the amount you paid for the affected license.
These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that applicable law does not allow us to limit. Mandatory consumer rights in your place of residence remain unaffected.
12. Suspension and termination
We may suspend or terminate a license if you materially breach these terms, use a fraudulent or refunded transaction, share a license key publicly, or interfere with the licensing service. Where the issue can reasonably be fixed, we will normally give you an opportunity to do so. You may stop using PommeToys at any time.
On termination, your right to use the software ends. Sections concerning ownership, warranties, liability, and any payment or legal obligations that by their nature should survive will remain in effect.
13. Changes to these terms
We may update these terms to reflect product, legal, or security changes. The current version and update date will remain on this page. If a change materially affects existing customers, we will provide reasonable notice where possible. Changes will not retroactively reduce the perpetual-use and lifetime-upgrade rights already granted for a purchased PommeToys license unless required by law or necessary to address abuse or a security risk.
14. Apple trademarks
Mac, macOS, and Dock are trademarks of Apple Inc., registered in the U.S. and other countries. PommeToys is an independent product and is not affiliated with, endorsed by, or sponsored by Apple Inc.
